The debate about cannabis and its derivatives has intensified worldwide in recent years, and the island of Sint Maarten is no exception. Many people wonder if cannabis seeds are legal on the island. The answer depends on which part of the island one is referring to, as Sint Maarten has a unique political structure.
An island divided, two legal systems
The island of Saint-Martin is divided into two parts:
Sint Maarten (the southern part) belongs to the Kingdom of the Netherlands and is an independent country within the kingdom.
Saint-Martin (the northern part) is a French overseas territory, where French law applies.
So the laws on cannabis differ between the two parts of the island.
The situation on the Dutch part – Sint Maarten
Although Sint Maarten is part of the Kingdom of the Netherlands, the Dutch tolerance legislation on cannabis does not automatically apply there.
Unlike in the Netherlands, where possession of small amounts of cannabis is generally tolerated, cannabis remains completely illegal in Sint Maarten. This also applies to the possession, sale, and cultivation of cannabis.
Regarding cannabis seeds:
They do not contain THC and are not considered a narcotic in themselves.
Yet they are often associated with the intention to cultivate, which is against the law.
Therefore, the import, sale, or planting of cannabis seeds in Sint Maarten is prohibited without an official permit.
In short: legally speaking, there is no distinction between seeds and plants – both fall under the Prohibited Substances Act.
The situation in the French part – Saint-Martin
On the French side of the island, French law applies. Under French law, cannabis seeds are not prohibited as long as they don't germinate.
This means that, in theory, one is permitted to possess or collect cannabis seeds for decorative or collection purposes. However, once the seeds are planted or germinated, it is considered illegal cultivation of a narcotic drug.
The line between legal and illegal therefore lies at the germination of the seed.
